The pension of these individuals to be given to the child

The issue of pensions for individuals who have lost both parents is one of the frequently asked questions.

According to legislation, such individuals are not granted the pensions of both parents simultaneously. The social insurance periods and pension capital accumulated in the individual accounts of the parents are calculated, and as a result, only one pension – the pension of the parent with the higher amount – is assigned.

That is, a person cannot receive the pensions of both the father and the mother separately. During the calculation, the work experience, salary, and accumulated pension capital of both parents are considered, and the pension with the higher amount is assigned and received by the person.

Additionally, it should be noted that individuals who have lost both parents are generally entitled to a labor pension due to the loss of the head of the family. This pension right can be paid until the child reaches 18 years of age, or up to 23 years if the child is receiving full-time education, and during the disability period if the child is disabled. One of the main conditions for receiving a pension is that the deceased parents have official work experience and social insurance contributions.

Applications for pension assignment are submitted to the State Social Protection Fund together with the identity card, death certificates of the parents, birth certificate, and, if applicable, an education certificate. The pension amount is calculated according to the pension capital accumulated by the parents. (Nocomment.az)
