When an unauthorized construction is detected, the issue is formalized in accordance with the legislation and phased measures are taken.
Medianews.az reports that this information was provided by the State Property Issues Service in response to an inquiry from BAKU.WS.
According to the Service, employees of the authority regularly conduct monitoring across the country regarding the seizure of land plots and illegal use:
“According to the requirements of the Charter on ‘State Supervision over the Use of Lands and Their Protection’ approved by the Decree No. 421 of the President of the Republic of Azerbaijan dated November 28, 2000, the State Property Issues Service under the Ministry of Economy (hereinafter – the Service) is assigned the task of carrying out state supervision in this area, including preventing the seizure and illegal use of land plots observed during construction works.”
It is reported that an act is formalized in the following cases:
“If during monitoring, facts of construction works resulting in the unauthorized seizure (occupation) of land plots without the possession of ownership, use, or lease rights as stipulated by law are identified, this situation is formalized by the Service's employees with the relevant act.”
“Afterwards, depending on the nature of the violation of land legislation, the Service ensures that measures are taken to prevent cases of unauthorized seizure (occupation) of land plots, including informing the internal affairs bodies of the Republic of Azerbaijan based on clause 9.5 of the aforementioned Charter, as well as ensuring the administrative liability of officials and individuals in accordance with clause 11.5 of the Charter and in accordance with legislation.
At the same time, materials collected regarding illegal construction on land are sent to the State Urban Planning and Architecture Committee, the State Agency for Control of Safety in Construction under the Ministry of Emergency Situations, district (city) executive authorities, and other relevant agencies for taking appropriate measures within their authority,” the information stated.
