Penalty system in Azerbaijan CHANGES

"The draft law, on the one hand, serves to further strengthen the legal framework in this field, and on the other hand, contributes to increasing transparency through the formation of management and information systems. In particular, the expansion of the application of electronic services enables the strengthening of open governance at the institutional level. At the same time, the normative base for the legal regulation of the expenditure of state funds according to their designated purpose is further improved. In this regard, the implementation of the presented amendments is considered necessary, and there is no doubt that the draft law will have a positive impact on the ongoing economic reforms."

According to Medianews.az, these remarks were made by Vugar Bayramov during the discussion of the draft law on amendments to the Criminal Code at the plenary session of the National Assembly.

The deputy also made a number of proposals:

"According to the presented amendments, if the misuse of state funds under Article 308 of the Code is up to 10,000 manats, a fine equal to 100 percent of the damage—that is, the amount used outside of its purpose—is imposed, and in certain cases, there is a possibility of exemption from criminal liability."

He noted that while fines currently range between 9,000 and 13,000 manats, the new amendments apply a more criterion-based approach:

"That is, whereas previous documents specified fixed amounts, the new version determines the fine based on a criterion. It should be noted that the differential application of this criterion is important because specifying the exact amount of damage in the law creates clearer legal certainty."
