According to the statistics as of today in Azerbaijan, more than 402 thousand cases related to problematic loans have been referred to compulsory enforcement. This information was provided by the Ministry of Justice. It was stated that these enforcement cases under the jurisdiction of the local enforcement bodies of the Ministry are cases where the claimant party are banks and non-bank credit organizations.
Since these cases have been referred to compulsory enforcement, they are considered problematic loans.
There are many people in our country who take certain funds from banks and non-bank organizations and realize the purpose they set. However, there are also quite a few people who later do not pay or cannot pay that amount.
In general, what is included in the concept of problematic loans? To which debtors do the compulsory enforcement rules apply? What fate awaits those individuals?
Medianews.az reports that according to the expert lawyer Akram Hasanov, who spoke to Bizim.Media on this subject, a loan is understood only as a debt taken for a certain period.
"That is, it refers to goods purchased on credit from banks, non-bank organizations, pawnshops, trade networks. But in addition to problematic loans, the debt cases handled by enforcement officers and examined in courts also include alimony. Because it is also a debt. In this sense, it is related to this. Its payment mechanism is the same. It does not matter for the court or the enforcement officer whether the citizen takes a loan and does not repay it, or the parent does not pay alimony."
The expert stated that no action can be taken against a person who does not pay the debt by law:
"The law says that if a person does not have the means, no action can be taken against him. However, in our country, they say that the person will be arrested, they prohibit exit from the country, and sometimes even fine him. The person does not have money to pay the debt, but the court additionally fines him. The solution to these matters is the same, if he has money, he pays, if not, he cannot pay, and all measures taken against this are illegal."
