Medianews.az reports that according to the legislation, such individuals are not granted the labor pension of both parents at the same time. The social insurance record and the pension capital accumulated in the individual accounts of the parents are calculated, and as a result, only one pension — the higher amount of the parents' pensions — is assigned.

In other words, a person cannot receive the pensions of both the father and the mother separately. During the calculation, the work experience, wages, and accumulated pension capital of both parents are taken into account, and the higher amount is assigned as the pension, which the person then receives.

Additionally, it should be noted that individuals who have lost both parents are usually entitled to a labor pension due to the loss of the head of the family. This pension entitlement can be paid until the child reaches 18 years old, or until 23 years old if attending full-time education, and for the duration of the disability if the person is disabled. One of the main conditions for receiving a pension is that the deceased parents have official work experience and social insurance payments.

Applications for pension assignment are submitted to the State Social Protection Fund along with the identity card, the death certificates of the parents, the birth certificate, and if in education, a certificate of education.
