In Azerbaijan, during the purchase and sale of automobiles, some citizens prefer to obtain a power of attorney with the right to give instructions rather than registering the vehicle in their own name.
Although this method can sometimes save time and additional costs, it can later lead to various legal problems. According to current legislation, while the holder of the power of attorney with the right to give instructions can drive, sell, or carry out other operations with the vehicle, they cannot directly register the vehicle in their own name.
Speaking to Sfera.az on this topic, transportation expert Elmaddin Muradli stated that this restriction arises from the requirements of the legislation and is a legally justified mechanism.
According to the expert, the power of attorney with the right to give instructions only allows the vehicle to be registered in the name of a third party:
"The person receiving the power of attorney cannot transfer the vehicle to their own name. This is a rule defined by law and citizens should be aware of it. I believe that the main focus should be on simplifying the procedures for the state registration and re-registration of vehicles rather than changing the rules related to powers of attorney. If this happens, people would prefer to register the vehicle directly in their own names instead of driving it with a power of attorney."
E. Muradli noted that driving a vehicle with a power of attorney has posed various risks for many years, and many citizens have faced legal problems because of this:
"This has been discussed many times, and the public has been informed. Nevertheless, some individuals still do not want to register the vehicle in their own names. However, the power of attorney itself is a risky mechanism."
The expert believes the main danger is that the legal owner of the vehicle remains a different person:
"Sometimes people keep the vehicle registered in the name of the person they bought it from, without checking who that person is, or whether they have any debts, court disputes, or other legal problems. Later, they face the consequences of this. Such cases have been encountered repeatedly in practice. Therefore, my advice to citizens is that when buying a vehicle, they should definitely register it in their own name. This is the most reliable way to avoid possible legal risks in the future."
